DWAI (Driving While Ability Impaired) can be separated into two different charges: DWAI-Alcohol and DWAI-Drug.

DWAI, or DWAI-Alcohol, is only a traffic violation, although the fines and penalties attached are more similar to DWI than they are a speeding ticket. It is a chargeable offense if your ability to drive is shown to be compromised, you are 21 or older, and you have a BAC of .05% to .07%.

DWAI-Drug, like DWI, is considered a crime in the eyes of the law. Unlike DWI, however, the court need only show that you are impaired – not completely intoxicated – to convict you of this crime. Everything else about the charge is almost identical to DWI: the fines, penalties, classes, etc. However, in the nature of the crime, there is no breathalyzer for drugs, and so the ignition interlock device is not required.

There is also the charge of DWAI-Combined Influence, which is driving while your ability is impaired by a combination of drugs or of drugs and alcohol. Other than having a different name, it is almost identical to DWAI-Drugs.

Whether you’ve been charged with DWAI (DWAI-Alcohol) or DWAI-Drug, the consequences are still about as serious as DWI. One might be considered a violation while the other two are a crime, but all havesignificant fines, increased insurance rates, mandatory classes, panels, and counseling, and suspensions of driver’s licenses. However, there is no required driver interlock device installation. Both DWAI charges both have long-term, less direct costs, such as fewer employment opportunities, denial of driving or piloting jobs, and some possible restrictions on military service.
